These Terms of Use ("Terms") govern your access to and use of the FiveFacts AI website at fivefactsai.com and any content, forms, and demo request features on it (the "Site"). By using the Site, you agree to these Terms. If you do not agree, do not use the Site.

In these Terms, "we," "us," and "FiveFacts" mean Atlas Human AI, LLC d/b/a FiveFacts AI. "You" means the person or business using the Site.

1. Who may use the Site

The Site is intended for business use by people who are at least 18 years old and can form a binding contract. By using the Site, you represent that you meet these requirements and that any information you provide is accurate.

2. The demo

The Site lets you request a live demo. A demo is a short, illustrative run of our service. It is offered as-is for evaluation. Requesting a demo does not create any obligation to buy, and it does not entitle you to any particular result. Additional terms apply to the demo, including our SMS Program Terms and, where relevant, a separate demo or pilot agreement.

For calls and text messages connected with the demo, the SMS Program Terms, including their binding arbitration agreement and class-action waiver, are incorporated into these Terms when you accept them at the demo consent checkbox.

3. No reliance

Content on the Site is provided for general information only. It is not advice of any kind, including legal, compliance, financial, tax, or regulatory advice. Descriptions of features, controls, results, and performance are illustrative and may change. You should not rely on the Site as the basis for any decision. You are responsible for your own compliance obligations and should consult your own advisors. Any performance figures shown are examples and are not a promise of future results.

4. Intellectual property

The Site and its content, including text, graphics, logos, layouts, software, and the names "FiveFacts" and "FiveFacts AI," are owned by or licensed to us and are protected by intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to view the Site for your own business evaluation. You may not copy, reproduce, republish, scrape, frame, sell, or create derivative works from the Site or its content without our prior written permission. All rights not expressly granted are reserved.

5. Acceptable use

When using the Site, you agree not to:

• Break any law or infringe anyone's rights.
• Submit false, misleading, or someone else's personal information without authorization.
• Interfere with, disrupt, or overload the Site or its infrastructure.
• Attempt to gain unauthorized access to any system, account, or data.
• Probe, scan, or test the vulnerability of the Site without our written permission.
• Use bots, scrapers, or automated means to access or collect from the Site, except standard search-engine indexing.
• Introduce malware or any harmful code.
• Reverse engineer or attempt to derive source code, except to the extent this restriction is prohibited by law.
• Use the Site to compete with us or to build a similar service.

We may suspend or terminate your access for any violation, and we may report unlawful activity to authorities.

6. Your submissions

If you submit information through the Site, including a demo request, you represent that you are authorized to submit it and that it is accurate. You grant us the right to use that information to respond to you and to provide the demo and related services, as described in our Privacy Policy.

7. Third-party links

The Site may link to third-party websites or resources. We do not control them and are not responsible for their content, products, or practices. Links are provided for convenience only and are not an endorsement.

8. Disclaimers

The Site and the demo are provided "as is" and "as available," with all faults and without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by law, we disclaim all warranties, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and any warranty arising from course of dealing or usage of trade. We do not warrant that the Site will be uninterrupted, secure, error-free, or free of harmful components, or that any content is accurate or complete.

9. Limitation of liability

To the fullest extent permitted by law, in no event will FiveFacts, its members, officers, employees, or suppliers be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business, arising out of or relating to your use of the Site or the demo, whether based on contract, tort, strict liability, or any other theory, even if we have been advised of the possibility of such damages. To the fullest extent permitted by law, our total liability for all claims relating to the Site or the demo will not exceed one hundred U.S. dollars (USD 100). Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

10. Indemnification

You agree to indemnify and hold harmless FiveFacts and its members, officers, and employees from any claims, damages, losses, liabilities, and expenses, including reasonable legal fees, arising out of or related to your use of the Site, your submissions, or your breach of these Terms.

11. Changes to the Site and these Terms

We may change, suspend, or discontinue any part of the Site at any time. We may also update these Terms from time to time. Changes take effect when we post them and update the "Last updated" date. Your continued use of the Site means you accept the updated Terms.

12. Governing law and venue

These Terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-laws rules. You agree that any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Wyoming, and you consent to the personal jurisdiction of those courts. Nothing in this section limits any separate written agreement between you and us that specifies a different forum or dispute process.

13. Miscellaneous

If any provision of these Terms is found unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent. We may assign them. These Terms, together with the Privacy Policy and any agreement you sign with us, are the entire agreement between you and us about the Site.
