Privacy Policy

This policy explains what information FiveFacts AI collects, how we use it, and the choices you have. It covers our website and the demo we offer through it. Please read it with our Site Terms and, if you take part in a demo, our SMS Program Terms.

Who we are

FiveFacts AI provides a white-label AI voice and text service that businesses use to contact and qualify their own leads. In this policy, "we," "us," and "FiveFacts" mean Atlas Human AI, LLC d/b/a FiveFacts AI. "You" means a visitor to our website or a person who requests a demo.

We act in two different roles, and this policy is organized around that split:

1. As a business, for our own website and demo. Here we decide why and how information is used. That makes us the controller of that information. 2. As a service provider to our clients. When a client uses our platform to process records about their own leads, the client decides why and how those records are used. In that role we process the records on the client's behalf. That makes us a processor. See "Service data we process for clients" below.

Information we collect

Information you give us on the application form. When you request a demo, we ask for a small set of details so the demo can run: your name, your business or shop name, your email address, your role, your mobile phone number, and, optionally, the approximate size of your book of business.

When you submit the form, we also record the date and time, the version of the consent text you were shown, whether you checked the consent box, and the IP address the submission came from. We keep this submission record so we have a reliable record of your request and your consent. To respond quickly, we may send an internal notification containing your submission to our own team through a third-party messaging service; we do not use that service to market to you.

Consent and contact records

If you check the consent box on the application form, we store a record of that consent. This includes the date and time, the version of the consent text shown, and whether the box was checked. We keep this record so we can show when and how you agreed to be contacted.

Demo interaction data

If you book and take a live demo, our agent may call and text the mobile number you provided. We collect records of those calls and texts, including timestamps, call and message outcomes, and, where calls are recorded, the recording and any transcript. We tell you when a call may be recorded.

Information we collect automatically

When you visit our website, we and our analytics providers may collect standard technical information, such as your IP address, browser type, device type, pages viewed, referring page, and general location inferred from your IP address. We use cookies and similar technologies for this. You can control cookies through your browser settings.

Information from third parties

We may receive limited information from service providers that help us run the website, the demo, or our analytics. We do not buy marketing lists to populate the demo.

Mobile opt-in and consent

Mobile opt-in data and consent will not be shared with or sold to third parties for marketing purposes. Your mobile number and your consent record are used to run the demo you asked for and to follow up about it, and for nothing else, unless you give separate permission.

How we use information

We use the information above to:

  • Set up, schedule, and run the demo you request.
  • Call and text the mobile number you provide for the demo and follow-up, if you consented.
  • Respond to your questions and provide support.
  • Operate, secure, and improve our website and services.
  • Keep records we need for legal, compliance, and audit purposes, including consent records.
  • Detect and prevent fraud and abuse.

We do not sell your personal information. We do not use your mobile opt-in data for marketing by third parties.

Service data we process for clients

Our clients use the FiveFacts platform to contact and qualify their own leads. To do that, a client's deployment processes records about those leads, which can include names, business names, contact details, contact histories, call and text transcripts, and qualification facts. We call this service data.

For service data, the client is the controller and we are the processor. We process service data only on the client's documented instructions and under our agreement with that client. Each client runs in an isolated deployment. Service data from one client is never used to serve another client, and we do not use the content of service data to train or fine-tune any machine-learning model. If you are a lead contacted through a client's deployment and you want to exercise rights over your information, please contact that client. We will support the client in responding.

How we share information

We share information only as needed and only in these ways:

  • With service providers who help us run the website, the demo, analytics, hosting, telephony, and messaging, under contracts that limit their use of the information to providing those services.
  • To comply with law, legal process, or a lawful request from authorities.
  • To protect the rights, safety, and property of FiveFacts, our clients, or others.
  • In connection with a merger, acquisition, or sale of assets, subject to this policy.

We do not share or sell mobile opt-in data or consent for third-party marketing.

Retention

We keep personal information for as long as we need it for the purposes described in this policy, and then we delete or de-identify it. Consent and contact records are kept for at least four years to meet legal and audit needs. Demo interaction data, including recordings and transcripts, is kept for the period stated at the time of the demo or in our agreement, and then deleted. Analytics data is kept on a rolling basis. Service data is retained and deleted according to our agreement with the relevant client, including deletion on termination.

Security

We use reasonable administrative, technical, and physical safeguards designed to protect information. No system is perfectly secure, so we cannot guarantee absolute security.

Your privacy rights

Depending on where you live, you may have rights over your personal information. These can include the right to:

  • Know what personal information we hold about you and access it.
  • Correct inaccurate personal information.
  • Delete your personal information.
  • Obtain a portable copy of your personal information.
  • Opt out of the sale or sharing of personal information for targeted advertising. We do not sell personal information or use it for that purpose.
  • Limit the use of sensitive personal information.
  • Not be discriminated against for exercising your rights.

To exercise a right, contact us at privacy@fivefactsai.com. We will verify your request before acting on it and respond within the time the applicable law requires. You can ask us to delete your application and the personal information in it, and we will, except that we retain the consent and contact record described under "Retention" for at least four years to meet our legal and audit obligations, as the law permits. You may use an authorized agent where the law allows. If we deny a request, you may appeal by replying to our response. For service data held on a client's behalf, please contact the client, and we will assist them.

Children

Our website and services are for businesses and are not directed to children. We do not knowingly collect personal information from children.

Changes to this policy

We may update this policy from time to time. When we do, we will change the "Last updated" date above and, where appropriate, provide additional notice.
